什么是PPP500?
为了更加有效率和节省分割财产的费用,澳洲也有类似于中国小额诉讼程序的制度,即Priority Property Pools under $500,000 cases(缩写为PPP500,即财产池低于$500,000案件)。从2020年3月1日起,澳大利亚联邦巡回法院(the Federal Circuit Court of Australia)在阿德莱德,布里斯班,墨尔本和帕拉马塔进行PPP500案件试点。
PPP500 案件的依据是1975 年《家庭法》(Cth)第 79 条或第 90SM 条《家庭法》(可能适用)。PPP500 案件试点旨在通过提供一种解决财产纠纷的简化方式,对弱势当事人进行保护。通过将风险和法律成本降至最低的方法,最好的保护当事人的资产。

PPP500申请诉讼程序
(1) 可以通过填写和提交Initiation Application(申请表)和PPP500 Financial Summary Form (财产摘要)来启动PPP500诉讼程序。
(2) 登记官(Registrars)会审查所有提交的申请,并在第一个开庭日期之前在作出命令(orders)来处理PPP500案件。

In order to be more efficient and save the cost of dividing property, Australia also has a system similar to China's small claims procedure.Priority Property Pools under $500,000 cases(PPP500) is an application for alteration of property interests pursuant to section 79 of the Family Law Act 1975 (Cth) (Family Law Act) or section 90SM Family Law Act (as may apply) filed after 1 March 2020 in the Pilot location. The Pilot operates in the following registries of the Federal Circuit Court of Australia:Adelaide, Brisbane, Melbourne and Parramatta.

PPP500’s scope of application
(1) the net property of the parties (including superannuation interests) is, or is likely to be, $500,000 or less, and
(2) there are no entities (such as a family trust, company, or self-managed superannuation fund) owned or in the effective control of either party that might require valuation or expert investigation, and
(3) neither party in the proceedings seeks orders:
a. for parenting or any other order pursuant to Part VII of the Family Law Act
b. pursuant to the Child Support (Assessment) Act 1989 and/or the Child Support (Registration and Collection) Act 1988 , or
c. by way of an enforcement of an order or obligation whether a parenting or financial obligation.
